One may argue that the Japanese government was perfectly justified to do what it did given the nature of the incident (ramming of a Japanese law-enforcing ship in what the Japanese side considers to be its territorial water) or Japan should have done so before, but the fact of matter is that the Japanese government’s decision to try the Chinese captain according to Japanese domestic law was a departure from past Japanese practice.
